The EU's ban on TPO (Trimethylbenzoyl Diphenylphosphine Oxide) in gel nail polishes has now taken full effect as of September 1, 2025. Indian businesses and exporters must comply with this ban immediately, as no grace period or exception exists for selling or using products with TPO within Europe.

 

Overview of the Regulation

Commission Regulation (EU) 2025/877 (Omnibus VII) officially prohibits TPO in all cosmetic products, including nail gels and polishes, from September 1, 2025. This action amends the Cosmetics Regulation (EC) No 1223/2009, following Delegated Regulation (EU) 2024/197, which classified TPO as a Category 1B reproductive toxicant (CMR). Previously, TPO was allowed in professional use at up to 5% concentration, but now its use, sale, and distribution are completely banned.

Rationale Behind the Ban 

The EU classifies TPO as "toxic to reproduction" meaning it may harm fertility or unborn children, prompting automatic prohibition under EU cosmetics law. Regulatory bodies, including the HPRA, have clarified that no exceptions or transitional extensions were granted, and all products containing TPO must be stopped from trade and commercial use from the deadline. Even products bought before September 1 cannot be sold, gifted, or used in salons anymore.

From today, Indian exporters in the cosmetics trade with EU countries must halt exports of all TPO-containing gel nail products. Compliance is compulsory; any violation risks penalties or market withdrawal. The absence of a "sell-through" or grace period means existing stocks with TPO cannot be legally distributed or used in the EU.
